LE DROIT INSTITUTIONNEL: LE CONTROLE JURISDICTIONNEL - DISPENSA DI DROIT DE L'UNIONE EUROPEEN, ECOLE NATIONALE DE LA MAGISTRATURE BORDEAUX - FRANCE

The principle theme of this paper is the analysis of the competences of the Court of Justice of European Union, taking care to emphasize, first, the type of judicial review in place, and secondly, what is the value for each of the skill examined, in the community legal system. To this end it is first examined the direct control of the legality of acts and behavior of community institutions (action for annulment, failure to act, objection of illegality, tort liability action and compensation of damages) and then proceed to judicial review on the correct application of community law in the Member States (infringement proceedings) and complete analysis with cooperation between the European judges and National courts through, in particular, the tool of reference for preliminary ruling.

Il tema principale della dispensa è costituito dall’analisi delle competenze del giudice comunitario, avendo cura di sottolineare , da un lato, il tipo di controllo giurisdizionale posto in essere, e dall’altro, quale sia la valenza, per ciascuna delle competenze esaminate, nel sistema giuridico comunitario. A tal fine viene anzitutto esaminato il controllo diretto sulla legalità degli atti e dei comportamenti delle istituzioni comunitarie (ricorso in annullamento, ricorso in carenza, eccezione d’illegalità, azione in responsabilità extra-contrattuale) per poi passare al controllo giurisdizionale sulla corretta applicazione del diritto comunitario negli Stati membri (ricorso per inadempimento) e terminare analizzando la cooperazione tra giudice comunitario e giudici nazionali attraverso, in particolare, lo strumento del rinvio pregiudiziale.
