La necessità di ricorrere alle risorse agricole, oltre che per ottenere prodotti alimentari anche energie non è nuova. In questa fase tuttavia le agro-energie sono chiamate a sostenere alti livelli di sviluppo. Per evitare che il mercato energetico entri pericolosamente in concorrenza con il mercato alimentare, l'art. 44 Cost. può ancora offrire preziose indicazioni.
