Le notificazioni al querelante

The transitional provision pursuant to art. 86 of D. lgs. no. 150/2022 provides that the simplified system of service of documents to the offended person who has filed a complaint will apply only to complaints presented after the entry into force of the decree, except in cases in which the plaintiff has in any case proceeded – even though there is not yet formally required – to declare or to elect domicile, or to appoint his trusted defender.

La disposizione transitoria di cui all'art. 86 del d.lgs. n. 150/2022 prevede che il regime semplificato di notificazione degli atti alla persona offesa che abbia presentato querela si applicherà solo alle querele presentate dopo l'entrata in vigore del decreto, salvi i casi in cui il querelante abbia comunque provveduto – pur non essendovi ancora formalmente tenuto – a dichiarare o ad eleggere domicilio, ovvero a nominare il proprio difensore di fiducia.
