Il controllo di meritevolezza sui contratti “conformati” dalle Autorità indipendenti

The regulatory power of the independent authorities can take the form of the power to integrate and conform the contracts of the markets regulated by each. However, it is not a free and uncontrolled power: on the contrary, it is a power that has a specific function, that consequently has limits and that is – and cannot fail to be – subject to control. In the complex system of controls on the “conformed” contract, a significant role can be played by the judgment of “meritevolezza”: it has as object not administrative regulation, but the contract, and requires to verify its suitability to realize the principles which, from time to time, appear relevant.

Il potere normativo delle autorità indipendenti, che può declinarsi anche in una potestà di integrare e conformare i contratti dei mercati di volta in volta regolati, non è certamente un potere libero e incontrollato: al contrario, è un potere che ha una precisa funzione, che di conseguenza conosce dei limiti e che è - e non può non essere - soggetto a controllo. Nel complesso sistema di controlli sul contratto conformato, svolge un ruolo significativo anche il giudizio di meritevolezza, che ha ad oggetto non l’atto o il regolamento amministrativo, bensí direttamente il contratto, imponendo di verificarne l’idoneità ad attuare correttamente i princípi di caso in caso rilevanti.
