Gli incerti confini tra esclusione e licenziamento del socio lavoratore

L'étude est consacrée à la reconstruction des aspects problématiques de la nature giusprivatistica concernant le poste de travailleur social dans les sociétés coopératives. Le législateur a, en effet, après avoir procédé à une révision importante des règles de la société coopérative avec une référence particulière à l'encadrement des travailleurs sociaux réglementaire, ainsi que la distinction entre la relation d'association et la relation d'emploi est abordée (cd loi. Biagi) pour confirmer la prééminence de la relation associative de l'œuvre. Le Ministère du travail et social, enfin, avec sa circulaire a mieux défini les contours de la relation entre la coopérative et les travailleurs-membres.

The study is dedicated to rebuilding the problematic aspects of nature giusprivatistica regarding the position of social worker in cooperative societies. The legislature, in fact, after having carried out a significant revision of the rules of the cooperative society with particular reference to the operating framework for regulatory social worker, as well as the distinction between the associative relationship and the employment relationship is further addressed (Law cd. Biagi) to confirm the pre-eminence of the associative relationship of the work. The Ministry of Labour and Social Policies, finally, with its circular has better defined the contours of the relationship between the cooperative and worker-members.

Lo studio si occupa di ricostruire i profili problematici di natura giusprivatistica relativi alla posizione del socio lavoratore nelle società cooperative. Il legislatore, infatti, dopo aver attuato una significativa revisione della disciplina della società cooperativa con particolare riferimento all’inquadramento normativo del socio lavoratore, nonché alla distinzione tra rapporto associativo e rapporto di lavoro, è ulteriormente intervenuto (legge cd. Biagi) a confermare la preminenza del rapporto associativo su quello di lavoro. Il Ministero del Lavoro e delle Politiche Sociali, infine, con propria circolare ha meglio precisato i contorni del rapporto tra cooperativa e soci lavoratori.
