Il giudice amministrativo al cospetto dei poteri discrezionali dell’amministrazione

The essay reviews the theories of doctrine and jurisprudence on the exercise of discretionary and binding powers by public administrations, examining their na- ture, limitations, and focusing on judicial review by administrative courts. Regar- ding this latter aspect, it highlights how the French administrative judge has made their scrutiny of discretionary acts significantly more thorough, allowing for their annulment.

Il saggio ripercorre le tesi di dottrina e giurisprudenza sull’esercizio dei poteri discrezionali e vincolati delle amministrazioni, esaminandone la natura, le limitazioni e soffermandosi sul controllo giurisdizionale da parte del giudice amministrativo. In merito a tale ultimo aspetto, si evidenzia come il giudice amministrativo francese ha reso ben più penetrante il suo scrutinio sugli atti discrezionali, consentendone l’annullamento.
