Access to post-mortem assisted reproductive techniques raises a series of issues that may affect the potential recognition of the filiation status of the child and their capacity to inherit from the deceased father. This paper, in addressing these matters, aims to reconstruct the most complex application and interpretative questions, with primary consideration given to the best interests of the child, which serves as a guiding principle for an axiologically informed interpretation of the relevant legislation.
L’accesso a tecniche di p.m.a. post mortem solleva una serie di problematiche tali da incidere sul possibile riconoscimento dello status filiationis del nato e sulla sua capacità a succedere rispetto al padre premorto. Il presente lavoro, con riferimento a tali tematiche, si occupa di ricostruire le questioni applicative e interpretative più spinose, avuto riguardo principalmente al best interest of the child, quale criterio guida utile ad un’interpretazione assiologica- mente conformata della normativa di riferimento.
