Respingimenti, rimpatri e asilo: la tutela degli immigrati irregolari nell’UE

The work focuses on the rights of illegal citizens of States not members of the European Union. In particular, it is considered the principle of non-refoulement and, therefore, the prohibition of collective expulsions. In addition, it assessed the effectiveness of the safeguards system designed for the protection of fundamental rights of illegal migrants and we highlight the most useful remedies that should be introduced to make the most appropriate system. In this context, is considered the discipline and international jurisprudence and the European Union. Finally, it identified the core of rights guaranteed to illegal migrants in the Members States of EU.

Il lavoro si sofferma sui diritti dei clandestini cittadini di Stati non membri dell’Unione europea. In particolare, è esaminato il principio di non refoulement e, quindi, il divieto di espulsioni collettive. Inoltre, è valutata l’effettività del sistema di garanzie predisposto a favore della protezione dei diritti fondamentali dei migranti illegali e/o clandestini e sono evidenziati i correttivi più utili che dovrebbero essere introdotti per rendere più adeguato tale sistema. In questa ottica, è esaminata la disciplina e la giurisprudenza internazionale e dell’Unione europea. Infine, è individuato il nucleo di diritti garantiti ai migranti irregolari in ambito nazionale.
