The judgment of the Council of State annulling the resolution of the Municipality of Venice establishing the surcharge on air boarding fees raises significant questions of law in terms of the obligation to state reasons for the act and the legitimacy of the choices relating to the desti-nation of the revenue. The conclusions reached by the judges cannot be shared as they disre-gard a detailed examination of the criteria for the classification of administrative acts and the consequent legal discipline applicable to them. In addition, the arguments based on the lack of a link between the revenue and the beneficiaries of the services financed by it, which, according to the judges, would support the complaints of lack of proportionality, are also not convincing.
La sentenza del Consiglio di Stato che annulla la delibera del Comune di Venezia istitu-tiva dell’addizionale sui diritti di imbarco aereo pone rilevanti questioni di diritto in pun-to di obbligo di motivazione dell’atto e di legittimità delle scelte relative alla destinazione del gettito. Le conclusioni cui giungono i giudici non possono essere condivise in quanto prescindono da un esame puntuale dei criteri di classificazione degli atti amministrativi e della conseguente disciplina giuridica ad essi applicabile. Inoltre, non convincono nep-pure le argomentazioni fondate sulla mancanza di un nesso tra le entrate e i beneficiari dei servizi con esse finanziate, che varrebbero ad avallare, secondo i giudici, le censure di difetto di proporzionalità.
